This Privacy Policy explains how Rare Beauty, LLC (“ Rare Beauty ” or “ we ”) collects, uses, and discloses information about you. This Privacy Policy applies to information we collect when you use our website, and other online products and services (collectively, our " Services "), contact our customer service team, engage with us on social media, attend on e of our events, or when you otherwise interact with us.

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of the policy . If we make material changes, we will provide you with additional notice (such as adding a statement to our homepage or sending you a notification). We encourage you to review this Privacy Policy regularly to stay informed about our information practices and the choices available to you.


Collection of Information

Personal Information You Provide Directly to Us

We collect personal information directly from you, including when you create an account, submit or post product reviews via our Services, make a purchase or donation, communicate with us via third-party platforms, participate in an event, request customer support, or otherwise communicate with us. The types of personal information we may collect directly from you include your name, email address, birth month and day, postal address, phone number, photos, makeup and color preferences, age range, product review information social handles, and any other information you choose to provide. In some cases, we may also collect information you provide about others, such as if you purchase a gift card for someone or decide to purchase and ship products to someone.

If you make a purchase from us, we work with third-party payment processors and financing partners to collect and process your payment information.

 

Personal Information We Collect Automatically When You Interact with Us

When you access or use our Services or otherwise transact business with us, we automatically collect personal information about you, including:

  • Transactional Information: When you make a purchase or return, we collect information about the transaction, such as product details, purchase price, any charitable donation you make in connection with your purchase, and the date and location of the transaction.

  • Device and Usage Information: We collect information about how you access and use our Services, including data about the device and network you use, such as your hardware model, operating system version, unique device identifiers, IP address, mobile network, browser type and app version, and language settings. We also collect information about your activity on our Services, such as items placed in your shopping cart, your access times, pages viewed, links clicked, and the page you visited before navigating to our Services.

  • Information Collected via Cookies, Web Beacons, and Other Tracking Technologies: We (and those that perform work for us) use cookies, web beacons, and other tracking technologies, to collect information about your browsing behavior, purchase behavior, and other engagement with our Services. Cookies are small data files stored on your hard drive or in device memory that help us improve our Services and your experience, see which areas and features of our Services are popular, and count visits. Web beacons (also known as “pixel tags” or “clear GIFs”) are electronic images that we use on our Services and in our emails to help deliver cookies, count visits, and understand usage and campaign effectiveness. We may also obtain information from other sources. For example, we may collect information about your purchases from international fulfillment partners. We may also collect information about you from social networks, identity verification services, advertising networks, and data analytics providers.

For example, we may infer your approximate location based on your IP address or infer that you are interested in purchasing certain types of products based on your browsing behavior and past purchases on our Services. 


Use of Personal Information

We use the personal information we collect to provide the Rare Beauty products you request. We also use personal information we collect to:

  • Provide, maintain and improve our products, Services, and other offerings;

  • Process transactions and returns and send you related information, including confirmations, receipts, invoices, customer experience surveys, and recall notices;

  • Process donations you may choose to make in connection with purchases; 

  • Personalize and improve your experience on our Services;

  • Monitor and analyze trends and statistics, learn more about your shopping preferences and your interaction with our Services, and improve your shopping experience;

  • Target advertisements to you on third-party platforms and websites unless you have opted out (see Opting Out of Targeted Advertising, Sharing, and Sales for more information);

  • Personalize the advertisements you see on third-party platforms and websites (for more information, see the   Advertising and Analytics  section below);

  • Personalize and improve the Services and provide content or features that match your profile and interests;

  • Facilitate contests, sweepstakes, and other marketing promotions and process and deliver entries and rewards;

  • Identify, report, and repair errors that impair the functionality of our Services;

  • Monitor and analyze trends, usage and activities in connection with our Services, events and other offerings;

  • Detect, investigate , and prevent security incidents and protect against malicious, deceptive, fraudulent, or illegal activity and protect the rights and property of Rare Beauty and others; and  

  • Comply with our legal and financial obligations.

 

Disclosures of Information

We disclose personal information in the following circumstances or as otherwise described in this Privacy Policy: 

  • We make personal information available to our vendors, service providers, consultants, and contractors who perform services on our behalf, such as companies that assist us with web hosting, shipping and delivery, financing and payment processing, charitable donations, fraud prevention, customer service, marketing, advertising, analytics, and customer service.

  • We may disclose your personal information to third parties to expand the reach and effectiveness of our own marketing campaigns. Depending on where you live, these activities may constitute “sales” and you may opt out of these disclosures by filling out our web form located here.

  • We may disclose certain information publicly on our Services or through our social channels, such as if you submit a product review or attend one of our events. 

  • In response to a request for information, we may disclose personal information if we believe disclosure is in accordance with, or required by, any applicable law, regulation, or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements.

  • We may disclose personal information if we believe your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to or to protect the rights, property and safety of Rare Beauty or others.

  • We may disclose personal information to our legal, financial, insurance, and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.

  • We may disclose personal information in connection with, or during negotiations of, any merger, sale of company assets, financing or acquisition of all or a portion of our business by another company.

  • We may disclose personal information between and among Rare Beauty and our current and future parents, affiliates, subsidiaries and other companies under common control and ownership.

  • We make personal information available to third parties when we have your consent or you intentionally direct us to do so.

 

We also disclose aggregated or de-identified information, which cannot reasonably be used to identify you. Rare Beauty processes, maintains, and uses this information only in a de-identified fashion and will not attempt to re-identify such information, except as permitted by law.

 

Targeted Advertising and Analytics

We engage others to provide analytics services, serve advertisements, and perform related services across the web and in mobile apps. These entities may use cookies, web beacons, SDKs, device identifiers and other technologies to collect information about your use of the Services and other websites and applications, including your IP address and other identifiers, web browser and mobile network information, pages viewed, time spent on pages or in apps, links clicked, and conversion information. This information is used to deliver advertising targeted to your interests on other companies’ sites or mobile apps and analyze and track data, determine the popularity of certain content, and better understand your online activity. Your Privacy Rights and Choices

Access, Correction, and Deletion

Depending on where you reside, you may have the right to (1) request to know more about and access your personal information, including in a portable format, (2) request deletion of your personal information, and (3) request correction of inaccurate personal information. As described in the Targeted Advertising and Analytics and Disclosures of Information sections above, we process and disclose personal information to serve you advertisements on third-party properties. Some of these activities may be considered “sales” or “sharing” of your personal information or “targeted advertising” under the law that applies to you. You may opt out of these activities by visiting our Services with a legally-recognized opt-out preference signal enabled (such as the Global Privacy Control) or by following the prompts here.

Marketing Communications

International Customers

Purchases by International Customers

Products purchased using our Services and shipped to a location outside of the United States are purchased from Global-e US Inc. (“ Global-e”) a different company that Rare Beauty has contracted with to handle international sales. When you purchase from Global-e the information you provide and other transaction information is provided by you to both Global-e and Rare Beauty (except for payment information, which is submitted exclusively to Global-e or its payment processors). Information provided by you to Rare Beauty in connection with these transactions will be handled by Rare Beauty in accordance with this Privacy Policy. Information provided by you to Global-e or its payment processor will be handled by Global-e in accordance with Global-e’s Privacy Policy. If you are an international customer and provide personal information to Rare Beauty separate from a purchase (such as by participating in an event or signing up for our email newsletter), that personal information is also subject to this Privacy Policy.   

 

Rare Beauty is based in the United States, and we have operations and service providers in the United States and other countries. Therefore, we and our service providers may transfer your personal information to, or store or access it in, jurisdictions that may not provide levels of data protection that are equivalent to those of your home jurisdiction. We will take steps to ensure that your personal information receives an adequate level of protection in the jurisdictions in which we process it.

If you withdraw your consent (or if you decide not to provide certain personal information), you acknowledge that Rare Beauty may not be able to provide you, or continue to provide you, with certain products, services , or information that may be of value to you.  

 

Access and Correction: Rare Beauty will take reasonable steps to ensure the personal information we hold is accurate , complete and up-to-date . Upon your written request, and subject to certain exceptions provided by law, Rare Beauty will inform you of the existence, use , and disclosure of your personal information and give you access to that information. Rare Beauty may charge a minimal fee for providing such access to you. If you believe that the personal information that Rare Beauty holds about you is not accurate or complete, you may write to the Rare Beauty at the email address provided below. If you are able to establish that the information is not accurate or complete, Rare Beauty will take reasonable steps to delete and/or correct the information so that it is accurate , complete , and up-to-date . In order to facilitate a request to correct or update information, Rare Beauty may ask you to provide additional information to confirm your identity. Any such information will only be used for the purpose of confirming your identity and will not be retained by Rare Beauty .  


European Residents

If you are located in the European Economic Area (“EEA”), the United Kingdom, or Switzerland, you have certain rights and protections under the law regarding the processing of your personal data, and this section applies to you.

Processing outside the EEA, UK, and Switzerland

Rare Beauty is a U.S. company, and so your personal data will be processed by us in the United States. The third parties we disclose your personal information to (as described in the Disclosures of Information section above) may be in a country whose privacy laws may not be as protective as those in your country of residence. Where this is the case, we provide adequate protection for the transfer of personal data, such as by executing Standard Contractual Clauses.
